Terms of Service

These Terms of Service ("Terms") are a contract between you and image.cooking for use of https://image.cooking and related services (the "Service"). By creating an account or using the Service you agree to these Terms, the Privacy Policy, and the Refund Policy.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

image.cooking is an AI image generation workspace. You choose a model, provide a prompt and optional reference images, see a Credits quote, and request a generation. Successful outputs are stored privately in My Creations for you to review and download.

The Service is provided on an as-available basis. Models, features, quotes, and availability can change. Paid checkout for kitchens and top-up packs charges a card only after you finish payment. New accounts may receive starter Credits with no card required.

• You must be at least 18 years old.
• You must provide a valid email address and keep your sign-in method secure.
• One person or organization should not create accounts to evade limits, bans, or Credits rules.
• You are responsible for activity that occurs under your account.

Credits are a prepaid meter for generation. They are not cash, not a stored-value account, and not transferable except as we expressly allow. Create shows the integer Credits cost for the current model and settings before you generate.

• When a generation starts, we reserve the quoted Credits.
• If the generation completes, the reserved Credits are consumed.
• If the generation fails or is cancelled, the reservation is often returned to your available balance. That return is not a purchase refund.
• A failed generation does not always return Credits. Some failures still consume the reserved Credits, including cases where a model provider was already invoked, a safety or policy check rejected the request after submission, or our platform rules require the charge to stand.
• We do not guarantee that Credits will be returned solely because a generation did not succeed.
• Deleting a creation from My Creations does not restore Credits.
• Starter Credits and promotional grants have no cash value and expire or change according to the grant terms we display.

Paid kitchens and top-up packs are listed in the catalog. Listing a price does not create a purchase until payment is completed. See the Refund Policy for purchase and Credits return rules.

You retain whatever rights you already have in prompts, uploads, and generated outputs, subject to the rights of others, model-provider terms, and applicable law. We do not claim ownership of your prompts or images.

You grant us a worldwide, non-exclusive license to host, process, transmit, and display your content solely to operate the Service for you. That includes sending prompts and reference images to AI model providers to fulfill a request you submit. If you submit an image to the public wall, you also grant us a worldwide, non-exclusive license to display that image and its prompt on image.cooking. Withdrawing the submission ends that public display.

You represent that you have the rights needed for every reference image you upload, including rights in likenesses, trademarks, and copyrighted works. You must not upload content you are not allowed to use.

AI outputs can be similar to other outputs, incomplete, inaccurate, or unexpected. We do not warrant that an output is unique, non-infringing, commercially usable, or fit for a particular purpose. You are responsible for how you use, publish, or sell outputs.

Model providers may impose additional terms on outputs. Those terms apply to your use of the relevant model. We may refuse, rate-limit, or fail a generation that a provider rejects, including safety filters.

You may not use the Service to:

• Violate law, including copyright, trademark, privacy, or publicity rights.
• Create or attempt to create sexual content involving minors, or any exploitation of children.
• Generate non-consensual intimate imagery, or content intended to harass, threaten, or defame.
• Impersonate a person or organization in a misleading way.
• Probe, disrupt, or overload the Service, bypass quotas, or reverse engineer except as allowed by law.
• Resell raw access to the Service or automated generation in a way that circumvents these Terms.

We may suspend or terminate accounts that we reasonably believe violate these Terms. We may remove content from the Service when required to protect users, providers, or the platform.

Generation depends on third-party model providers and infrastructure. Latency, failures, and model withdrawals are outside our exclusive control. We may modify, replace, or discontinue models and features. We will try to keep Credits quotes accurate at the moment you generate.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT OUTPUTS WILL MEET YOUR REQUIREMENTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGE.COOKING AND ITS OPERATORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR GENERATION RESULTS YOU FIND UNSATISFACTORY.

OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD 50). THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

You will defend and indemnify image.cooking against claims arising from your content, your use of outputs, or your violation of these Terms or of third-party rights, except to the extent caused by our willful misconduct.

You may stop using the Service at any time. We may suspend or close an account for violation of these Terms, risk to the Service, prolonged inactivity, or as required by law. Unused starter Credits have no cash value on closure. Unused purchased Credits are handled under the Refund Policy and applicable law.

These Terms are governed by the laws of the State of California, United States, excluding conflict-of-law rules, unless a mandatory consumer law in your country of residence says otherwise. Courts located in San Francisco County, California will have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction.

We may update these Terms. The effective date will change when we do. If you continue to use the Service after an update, you accept the revised Terms. If you do not agree, you must stop using the Service.
